Terms of Service
Hosting Services
If you are using our services to host your website (“Hosted Site”), you are bound by the following additional terms. You are solely responsible for all content, data, and materials on your Hosted Site, including its legality, reliability, and appropriateness. You warrant that you own or have the necessary rights to all content on your Hosted Site and that it does not infringe upon the intellectual property rights of any third party. You agree not to use our hosting services for any purpose that is unlawful or prohibited by these terms, including but not limited to, the transmission of any material that is harassing, defamatory, obscene, or that may violate any applicable laws or regulations. We reserve the right, but not the obligation, to monitor the content on your Hosted Site and to remove any content or suspend or terminate your hosting services at our sole discretion, without notice, for any conduct that we believe violates these terms or is otherwise harmful to us or any other party. We will perform daily backups of your Hosted Site. While we take reasonable measures to ensure the integrity and availability of these backups, we cannot guarantee against unforeseen data loss. We recommend maintaining your own local copies of critical data for your records. The hosting services are provided “as is” and we disclaim any warranty that the services will be uninterrupted or error-free. You agree to indemnify and hold harmless Launchbay Creative, LLC from any claims, damages, or expenses arising from the content or operation of your Hosted Site.
Support & Hosting Plan:
The monthly plan will consist of executing the following services.
Update WordPress to the latest version
Update WordPress plugins to their latest version
Backup website database and site files (once a day)
Optimize the WordPress database
Perform SPAM & revisions cleanup
Run regular security and performance scans
Perform support requests within an allotted 60 minutes a month
Provide ongoing email support
Refund
Refunds are available if services have been cancelled 14 days in advance of the next payment period.
Cancellation
You can cancel anytime. You are under no obligation to continue the ongoing service. We just ask you give us [14 days] notice so we can carry out our last thorough update of the website and remove our administrator credentials.
Force Majeure
Launchbay Creative shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that Launchbay Creative will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that Launchbay Creative cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
Failure to Pay
Reminders are sent 3, 7 & 14 days after payment is due in addition to a monthly invoice.
If payment is 30 days late Launchbay Creative reserves the right to put your site into maintenance mode until payment for hosting has been paid in full.
if payment is 60 days late Launchbay Creative reserves the right to delete your website from our hosting account.
